La contribución de la Corte Internacional de Justicia a la resolución del conflicto israelo-palestino : caso Nicaragua C. Alemania

El último conflicto israelo-palestino sitúa a la comunidad internacional ante un escenario dinámico que está modificando las Relaciones Internacionales. Pudiéramos encontrarnos ante un hito histórico de consecuencias impredecibles, capaz de abrir nuevos frentes bélicos y poner a prueba la efectividad de medios pacíficos diplomáticos y judiciales ante la presión mediática de la opinión pública mundial. En ese contexto geopolítico, históricamente convulso, de incuestionable actualidad y relevancia se enmarca nuestra investigación, cuyo objetivo es describir y analizar la contribución de la Corte Internacional de Justicia a la pacificación del conflicto israelo-palestino mediante la resolución del caso Nicaragua c. Alemania por su posible vulneración de la Convención para la Prevención y Sanción del Delito de Genocidio, de 9 de diciembre de 1948, como consecuencia del supuesto apoyo político, financiero y militar del Gobierno alemán al genocidio israelí en Gaza. A tal fin analizamos la jurisprudencia de la Corte relativa a los conflictos internacionales, al israelo-palestino en concreto, y al caso que nos ocupa en particular, para lo cual también hemos revisado la literatura académica disponible con objeto de inferir posibles pronunciamientos judiciales y sus consecuentes repercusiones. Entre las conclusiones destacamos que la Corte se encuentra ante una oportunidad histórica para reivindicar su aportación a la paz mundial.

The latest Israeli-Palestinian conflict places the international community before a dynamic scenario that is changing international relations. We could find ourselves before a historical milestone of unpredictable consequences, capable of opening new war fronts and testing the effectiveness of peaceful diplomatic and judicial means under the media pressure of world public opinion. It is in this historically convulsive geopolitical context, of unquestionable relevance and timeliness, that our research is framed, whose objective is to describe and analyze the contribution of the International Court of Justice to the pacification of the Israeli-Palestinian conflict through the resolution of the case Nicaragua v. Germany for its possible violation of the Convention on the Prevention and Punishment of the Crime of Genocide, of December 9, 1948, as a consequence of the alleged political, financial and military support of the German Government to the Israeli genocide in Gaza. To this end, we analyzed the jurisprudence of the Court regarding international conflicts, the Israeli-Palestinian conflict in particular, and the case at hand in particular, for which we also reviewed the available academic literature in order to infer possible judicial pronouncements and their consequent repercussions. Among the conclusions, we emphasize that the Court is facing a historic opportunity to vindicate its contribution to world peace.
